‘Smart’ Tsatsu wanted to buy time with Honyenuga recusal – Lawyer Sulley Sambian

A private legal practitioner Sulley Sambian has admitted that his senior colleague at the bar, Tsatsu Tsikata knew an objection founded on recusal of a judge is a serious matter.

According to him, the learned legal luminary was only engaging in what he termed “try your luck” which most lawyers do in order to buy more time.

Mr Tsatsu Tsikata who is the counsel for five individuals challenging the legality of Mr John Peter Amewu as the Member of Parliament (MP)-elect of Hohoe Constituency, on Monday raised an objection asking for the recusal of Justice Clemence Jackson Honyenuga, one of the five Justices of the Supreme Court hearing the case

His argument was that Justice Honyenuga was a close friend of Mr Amewu and therefore would be biased if he continued to be part of the five-member panel that will decide the case but the request was dismissed.

Reacting to this development, the lawyer said “Tsatsu undoubtedly is a smart lawyer. Perhaps one of the sharp lawyers we have in town.

Never for once think that he personally didn’t know his objection had no basis in law. He knew. But you see, in this game of the law, its sometimes ok to “try your luck” . He did but it didn’t work, hence the dismissal of his application as being without merit.

He knows fully well that an objection founded on recusal of a judge is a serious matter. We all remember the criminal case that eventually got him jailed. (later pardoned by John Kufuor but a pardon he refused)…if I remember very well he raised objections of bias even up to the appellate court but never was successful.

Strategic deployment of technical objections is also triggered when you know you are about to lose an application. At least man needs space to think. Unfortunately for Tsatsu, time is of the essence. The Supreme Court simply does not have time to grant long adjournments when Amewu is feverishly waiting to be sworn in on 7th January 2021…therein lies the problem”,
