A member of the New Patriotic Party (NPP) legal team, Lawyer Henry Nana Boakye has dismantled the election petition presented by the NDC to the Supreme Court.
According to lawyer Nana Boakye, the case has no merit and will not survive victory at the Supreme Court.
Lawyer Henry Nana Boakye made these allegations when he appeared on the Ekosii Sen Political program with Philip Osei Bonsu.He indicates that the NDC has not been able to prove a single polling station where Nana Addo Dankwa Akufo Addo was overvoted.He adds that this falls contrary to earlier claims by the NDC in several press conferences alleging there were incidents of over voting that favored Nana Addo Dankwa Akufo Addo.
“Not even a single paragraph of the petition did the NDC mention that, there were constituencies Nana Addo had over-voting. They had press conferences and said all sorts of things but they could not add it to their petition.Assuming without admitting, even if those over voting votes are added, it will not be up to 60,000. So why are they wasting the time of the court? Lawyer Nana Boakye asked.
He added that the errors committed by the Electoral Commission during the declaration of the Presidential results cannot in any way be challenged in court.According to him, the commission had then not gazetted the presidential results, and that makes it incontestable in court.
“What the constitution recognizes is the gazetted results. The constitution does not recognize the decelerating on the 9th of December. So it will not be appropriate to challenge that in court.
This is why we say there is no merit in the NDC case. They say the EC boss made mistakes on the 9th of December, because she used valid votes cast instead of total votes cast. The second mistake was the percentage of votes.
But the EC has said all those mistakes do not affect the entire results gazetted”. Lawyer Nana Boakye noted.
Lawyer Nana Boakye further alleged that the NDC has not challenged the validity of the election held. He says the NPP was expecting the NDC to have presented a valid result from their collation but that has not happened.
“They have not challenged the validity of the elections conducted at the primary or secondary level. We were expecting them to add all their results and tell us the number of votes John Mahama had, but that has not happened.
